This Privacy Policy (“Policy”) describes how RockWater Industries LLC (“RockWater,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit www.wearerockwater.com (the “Site”), subscribe to our newsletter, contact us, receive business communications from us, or otherwise interact with us in connection with our advisory services. By using the Site or providing us your information, you acknowledge the practices described in this Policy.

This Policy does not cover information we receive in the course of providing professional services to our clients under engagement agreements, which is governed by those agreements and any applicable confidentiality terms.

1. Information We Collect

We collect personal information in three ways: (a) information you provide directly, (b) information collected automatically when you use the Site, and (c) information from third parties.

a. Information you provide.

  • Contact form submissions: name, email address, company, and the contents of your message.
  • Newsletter signups: name and email address, collected via Site forms and via our newsletter platform.
  • Voluntary correspondence: any information you choose to send us via email or other channels.

b. Information collected automatically. When you visit the Site, we and our third-party service providers automatically collect:

  • Device and browser information (IP address, browser type, operating system, device identifiers);
  • Usage data (pages visited, time on site, referring URL, click data); and
  • Information collected through cookies, web beacons, pixels, and similar technologies (see Section 6).

c. Information from third parties. In support of our business development activities, we may obtain professional contact information (name, business email, job title, employer, public professional profile information) from publicly available sources, business databases, and third-party data providers. We use this information to identify potential clients and partners and to send relevant business communications. If you receive an email from us and wish to stop receiving them, you may unsubscribe at any time using the link in the email or by contacting us at hello@wearerockwater.com.

2. How We Use Your Information

We use personal information for the following purposes:

  • To respond to inquiries and provide the services or information you request;
  • To deliver our newsletter and other content you have subscribed to;
  • To send marketing and business development communications about our services, content, and events (you may opt out at any time);
  • To analyze and improve the Site and our marketing effectiveness;
  • To serve and measure advertising on third-party platforms and to retarget Site visitors;
  • To comply with legal obligations and protect our rights, our clients, our personnel, and the public; and
  • To facilitate corporate transactions such as a merger, acquisition, financing, or asset sale.

3. Legal Bases for Processing (EEA, UK, and Switzerland)

Where the EU GDPR or UK GDPR applies, we process personal data on the following legal bases:

  • Performance of a contract (e.g., responding to a service inquiry or delivering services you have requested);
  • Legitimate interests (e.g., business development, site analytics, securing the Site, and direct marketing to professional contacts), where those interests are not overridden by your rights;
  • Consent (e.g., where required for cookies, certain marketing communications, or sensitive processing); and
  • Legal obligation (e.g., complying with applicable law).

You have the right to withdraw consent at any time without affecting the lawfulness of prior processing.

4. How We Share Information

We do not sell personal information for monetary consideration. We share personal information only as described below:

  • Service providers that support our operations — including website hosting, email delivery, analytics, customer relationship management, and our newsletter platform. These providers are contractually limited to using personal information for the purposes for which we disclose it to them.
  • Advertising partners (including Meta/Facebook and LinkedIn) that help us measure and serve advertising. The use of cookies and pixels in this context may constitute “sharing” or “sale” of personal information under certain US state privacy laws. See Section 10 for opt-out information.
  • Professional advisors (e.g., attorneys, accountants, auditors) under appropriate confidentiality obligations.
  • Legal and safety disclosures if required by law or legal process, or to protect our rights, your safety, or the safety of others.
  • Business transfers in connection with a merger, acquisition, financing, or sale of assets, in which case personal information may transfer to the successor entity, subject to this Policy or a successor policy with substantially similar protections.

5. Third-Party Services We Use

The Site uses the following categories of third-party services, which may collect or process personal information under their own privacy policies:

  • Website platform (WordPress);
  • Newsletter delivery (beehiiv);
  • Advertising and analytics pixels (Meta Pixel, LinkedIn Insight Tag);
  • Web analytics and productivity tools (e.g., Google services); and
  • Email and business productivity tools used for client communications.

We are not responsible for the privacy practices of third parties.

6. Cookies and Tracking Technologies

The Site uses cookies, pixels, web beacons, and similar technologies for essential site functionality, analytics, and advertising. The categories of cookies we use include:

  • Strictly necessary — required for the Site to function;
  • Performance / analytics — help us understand how visitors use the Site; and
  • Advertising / targeting — including Meta Pixel and LinkedIn Insight Tag, used to measure and serve advertising.

You can manage cookies through your browser settings. Where required by applicable law, we honor Global Privacy Control (GPC) signals as opt-out requests for “sale” and “sharing” of personal information. If a cookie consent banner is presented to you on the Site, you may use it to make granular cookie choices.

7. Data Retention

We retain personal information only as long as reasonably necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. Newsletter subscriber information is retained until you unsubscribe. Inquiry and business development data is retained for the duration of our business relationship and a reasonable period thereafter for record-keeping and legal purposes.

8. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. No system is perfectly secure, and we cannot guarantee the absolute security of any information.

9. Children’s Privacy

The Site is not directed to individuals under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at hello@wearerockwater.com and we will delete the information.

10. Your Privacy Rights

For all users. You may unsubscribe from marketing emails at any time using the link in any marketing email or by contacting us at hello@wearerockwater.com. You may also contact us to ask what information we hold about you.

California residents (CCPA / CPRA). You have the right to:

  • Know what personal information we collect, use, disclose, and “share”;
  • Request access to and deletion of your personal information;
  • Correct inaccurate personal information;
  • Opt out of the “sale” and “sharing” of personal information, including for cross-context behavioral advertising;
  • Limit the use of sensitive personal information (we do not knowingly use sensitive personal information for purposes that would trigger this right); and
  • Be free from discrimination for exercising your rights.

To exercise these rights, email us at hello@wearerockwater.com with the subject line “California Privacy Request.” We will verify your identity before processing the request. Authorized agents may submit requests on your behalf with appropriate verification. We honor Global Privacy Control (GPC) signals as opt-out requests for “sale” and “sharing.”

Other US state residents. Residents of other US states with comprehensive consumer privacy laws — including Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia — may have rights to access, correct, delete, port, and opt out of targeted advertising, sale of personal data, and certain profiling activities. 11. International Data Transfers

We are based in the United States and process personal information in the United States. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required, we use appropriate safeguards (such as the Standard Contractual Clauses) to legitimize cross-border transfers.

12. Email Communications and Outreach

We send email communications for the following reasons:

  • Responses to inquiries you have submitted to us;
  • Newsletter content you have subscribed to receive; and
  • Business development outreach about our advisory services to professional contacts.

All marketing emails contain an unsubscribe link and our physical address, consistent with the U.S. CAN-SPAM Act. You may opt out at any time, and we process unsubscribe requests promptly.

13. Do Not Track and Global Privacy Control

Some browsers transmit “Do Not Track” (DNT) signals. Because there is no industry consensus on how to honor DNT, we do not currently respond to DNT signals. Where required by applicable law, we honor Global Privacy Control (GPC) signals.

14. Changes to This Policy

We may update this Policy from time to time. The “Effective Date” at the top indicates when it was last revised. Material changes will be communicated by posting the updated Policy on the Site and, where appropriate, by other means. Continued use of the Site after changes are posted constitutes acknowledgment of the updated Policy.
